Pre-Contractual Information<\/h5><p class=\"p1\">1.1 The traveler certifies that, prior to entering into a contract for a package tour, he or she has familiarized himself or herself with all the details of the package tour through the informational documents provided by the tour operator. The traveler expressly declares that he is aware of the characteristics and potential risks in the destination area and assumes responsibility for them.<\/p><p class=\"p1\">1.2 This information is also available on the website of the German Federal Foreign Office (www.auswaertigesamt.de). Travelers who are not German citizens should contact the relevant authorities on their own.<\/p><p class=\"p1\">1.3 The traveler is responsible for obtaining and carrying the travel documents required by the authorities, for any necessary vaccinations, and for complying with customs and foreign exchange regulations. Any disadvantages resulting from noncompliance (e.g., cancellation fees) shall be borne by him.<\/p><p class=\"p1\">1.4 If the tour operator accepts the traveler\u2019s request and assumes responsibility for organizing one of the destinations included in the itinerary, it may bill the traveler for the resulting costs, including all administrative fees incurred in completing the necessary formalities.<\/p><p class=\"p1\">1.5 Prior to the conclusion of the contract, the tour operator may at any time make changes to the service descriptions; the traveler will be informed of such changes before booking. The trip prices were calculated as of the date of publication of the itinerary and include all applicable taxes, fees, and additional costs listed therein. The total price of the package tour was calculated based on the exchange rates, transportation costs, fuel prices, and applicable taxes and fees in effect on the date the program was published. However, prices may increase up to a maximum of 20 days before departure, in accordance with the provisions set forth in the General Terms and Conditions of Travel. The traveler shall pay the outstanding amounts in accordance with the terms and conditions specified in the reservation confirmation. Under this agreement, the traveler is also entitled to a reduction in the travel price in the event of price fluctuations in his or her favor.<\/p><p class=\"p1\">1.6 Optional excursions that are not included in the original contract are not part of the package tour and are subject to their own terms and conditions; the tour operator does not guarantee that they will take place until the contract is concluded.<\/p><p class=\"p1\">1.7 The traveler has the right to cancel the travel contract at any time before the trip begins. In this case, the tour operator is entitled to demand payment of reasonable compensation in accordance with these Terms and Conditions. In the event of unavoidable, extraordinary or unforeseen circumstances in the destination area or its immediate vicinity that significantly impede the trip or the transportation of passengers to their destination, the traveler may cancel the contract before it begins without penalty and demand a refund of all payments already made.<\/p><p class=\"p1\">1.8 Such refunds or reimbursements will be made within a maximum of 14 days after the termination of the package tour contract.<\/p><h5 id=\"chapter2\">2. Conclusion of the Travel Contract<\/h5><p class=\"p1\">2.1 By registering for the trip\u2014which may be done in person, in writing, by telephone, by fax, or electronically\u2014the traveler makes a binding offer to the tour operator to enter into a travel contract in accordance with the terms of the trip description. The scope of the contractual services is determined exclusively by the description of services in the travel advertisement for the relevant period (e.g., advertisement, the tour operator\u2019s website, brochure), other pre-contractual information, and the details referring to these in the travel confirmation\/invoice. Other brochures published by the hotel or service provider do not form part of this contract. The organizer&#8217;s employees are not authorized to make any verbal side agreements. The travel contract is concluded upon the traveler&#8217;s receipt of the written travel confirmation.<\/p><p class=\"p1\">2.2 If the content of the travel confirmation differs from the content of the travel registration, this constitutes a new offer by the tour operator, to which the tour operator is bound for 10 days. The contract is concluded on the basis of this new offer if the traveler accepts it. Acceptance may be effected by a conclusive act, such as payment of the travel price, a down payment, or commencement of the trip.<\/p><p class=\"p1\">2.3 If the traveler does not have the tour operator\u2019s travel and payment terms and conditions when booking a trip by phone, they will be sent along with the travel confirmation\/invoice. The Terms and Conditions of Travel shall form an integral part of the travel contract, subject to the provisions of Section 2.2.<\/p><p class=\"p1\">2.4 Travel agents (e.g., travel agencies) and service providers (e.g., hotels, transportation companies) are not authorized to enter into agreements on behalf of the tour operator, provide information, or make representations that alter the agreed-upon terms of the package tour contract, go beyond the services contractually promised by the tour operator, or contradict the tour brochure.<\/p><p class=\"p1\">2.5 The pre-contractual information provided by the tour operator regarding the essential characteristics of the travel services, the travel price, and all additional costs, the payment terms, the minimum number of participants, and the cancellation fees shall not form part of the package tour contract unless this is expressly agreed upon by the parties.<\/p><p class=\"p1\">2.6 Bookings made through e-commerce are governed by the information provided on our website and the travel terms and conditions available there.<\/p><p class=\"p1\">2.7 In accordance with Regulation (EC) No. 2111\/2005, the traveler will be informed of the identity of the operating air carrier at the time of booking. If this is not yet known at the time of booking, passengers will first be informed of the identity of the likely operating air carrier and will be notified as soon as the identity is definitively determined. Any change in the operating airline after booking will be communicated immediately.<\/p><h5 id=\"chapter3\">3. Payment<\/h5><p class=\"p1\">3.1 Upon receipt of the travel confirmation, a deposit equal to 20% of the trip price is due. The remaining balance is due 30 days before the start of the trip, without the need for a further reminder. For trip registrations made less than four weeks before the trip begins, the full trip price is due immediately upon receipt of the trip confirmation, and payment can be made at the time of registration via credit card or PayPal.<\/p><p class=\"p1\">3.2 If you book online, you can pay for your trip by credit card or through PayPal. To do this, we need your address or, if applicable, the recipient&#8217;s information, as well as your consent to the charge on your credit card. You will also be presented with various payment options (one-time and two-time payments) to choose from.<\/p><p class=\"p1\">3.3 If the down payment and\/or the balance are not received on time, and if no payment is made even after a demand has been issued setting a deadline, the tour operator is entitled to cancel the travel contract and will charge the cancellation fees specified in Section 9.<\/p><h5 id=\"chapter4\">4. Transportation<\/h5><p class=\"p1\"><span class=\"s1\">4.1.  <\/span>The traveler is required to report to the place of departure specified in advance by the tour operator.<\/p><p class=\"p1\">4.2 The traveler is solely responsible for any loss or damage to carry-on luggage or other items the traveler is carrying while they are in the traveler\u2019s custody.<\/p><p class=\"p1\">4.3 If the traveler fails to show up for departure, the traveler forfeits the right to a refund of the amounts paid and agrees to make any payments still due. In this context, \u201cfailure to appear for departure\u201d refers to a failure to communicate the intention not to complete the trip and a failure to arrive at the designated location on time.<\/p><p class=\"p1\">4.4 If the traveler\u2019s failure to appear is due to force majeure, the traveler is entitled to a refund of the amounts paid, less administrative and cancellation fees. In this context, force majeure is defined as the death, an accident, or a serious illness affecting the traveler or a person living in the same household\u2014up to and including a second-degree relative\u2014as well as any similar circumstances that prevent the traveler from participating in the trip and of which the traveler has notified the tour operator in writing prior to departure.<\/p><h5 id=\"chapter5\">5. Changes to the Travel Contract<\/h5><p class=\"p1\">5.1 The tour operator reserves the right to amend the terms of the contract at any time prior to the start of the trip; in the event of minor changes, the tour operator will inform the traveler of such changes in a clear and understandable manner. In particular, the tour operator is entitled, within this framework, to subsequently change departure and arrival times as well as the airline providing the transportation to an equivalent airline, provided that this becomes necessary for reasons arising after the conclusion of the travel contract and that such changes are reasonable for the traveler.<\/p><p class=\"p1\">5.2 If, prior to the start of the trip, the tour operator is compelled to make substantial changes to any of the main features of the trip\u2019s services or is unable to meet a specific requirement of the traveler that was agreed upon in advance, the tour operator shall inform the traveler immediately in a clear and unambiguous manner. If the traveler decides to cancel the contract, he or she may choose an alternative trip offered by the tour operator. If possible, the quality of the trip offered is the same or better.<\/p><p class=\"p1\">5.4 In the event of a change to the contract or if a substitute trip is offered that is of inferior quality or lower price, the traveler is entitled to a corresponding reduction in the price.<\/p><h5 id=\"chapter6\">6. Price Changes<\/h5><p class=\"p1\">6.1 Price increases are permitted up to a maximum of 20 days before departure and only for the following reasons: a) based on the exchange rates used for the package tour b) due to changes in the cost of passenger transportation resulting from changes in the price of fuel or another form of energy. c) due to the level of taxes and fees on travel services included in the contract that are provided by third parties not directly involved in the organization of the trip, including fees, taxes, tourist taxes, landing fees, and port and airport fees.<\/p><p class=\"p1\">6.2 Only in the event of a price increase of more than 8% does the traveler have the right to terminate the contract without incurring a penalty. In this case, Clause 5 applies.<\/p><p class=\"p1\">6.3 The traveler is entitled to a reduction in the travel price based on the cases defined in a, b, and c of the first paragraph of this clause, provided that the costs are reduced in the traveler\u2019s favor. In this case, the tour operator deducts the actual administrative costs from the price reduction and issues the refund to the traveler.<\/p><h5>7. Transfer, Reassignment, and Changes to Services<\/h5><p class=\"p1\">7.1 The traveler has the right to transfer the travel contract to another suitable person who meets all the necessary conditions specified in the itinerary, within a reasonable period of time before the start of the trip, up to a maximum of To be transferred 7 days before arrival. Once the contract has been concluded, the traveler has no right to request changes regarding the travel dates, destination, point of departure, accommodations, or mode of transportation (rebooking). Requests to change reservations must always be reviewed by the tour operator and, if a change is possible, will be subject to a minimum fee of 30.00 \u20ac per transaction, plus Any additional costs that may actually arise as a result of the change in service providers.<\/p><p class=\"p1\">7.2 In all cases, in the event of any changes, the traveler and the substitute are solely obligated to the tour operator to pay the remaining balance of the trip, as well as any costs that may arise from a change to the trip.<\/p><h5>8. Cancellation by the Tour Operator<\/h5><p class=\"p1\">8.1 If the minimum number of participants required for the trip\u2014which is fewer than 25 people per trip or fewer than the minimum number of participants expressly specified in the contract\u2014is not reached, the tour operator may cancel the trip up to 5 weeks before the trip begins. In the event that the tour operator cancels the trip, the traveler is entitled to request participation in another trip of at least equal value if the tour operator is able to offer such a trip from its lineup at no additional cost to the traveler. The traveler must assert this right against the tour operator immediately after the tour operator issues its notice of cancellation. If the traveler does not exercise his or her right to participate in an equivalent trip, the travel price paid will be refunded immediately.<\/p><p class=\"p1\">8.2 The tour operator is entitled to terminate the travel contract without notice if, despite a warning, the traveler either disrupts the trip to such a significant extent or behaves in a manner so contrary to the contract that immediate termination of the contract is justified, including to protect other travelers. If the tour operator cancels the trip, it retains the right to the travel price, but must allow for a deduction for the value of the expenses saved as well as any benefits it derives from alternative use of the unused services, including any income credited or reimbursed to it by the service providers.<\/p><p class=\"p1\">8.3 The tour operator is entitled to withdraw from the travel contract before the start of the package tour without notice if, due to unforeseen and extraordinary circumstances (including force majeure), it is unable to carry out the tour in accordance with the contract. In this case, the tour operator shall immediately notify the traveler of the cancellation of the travel contract.<\/p><h5>9. Cancellation by the Traveler<\/h5><p>9.1 The traveler may cancel at any time. To avoid any misunderstandings, it is recommended that you submit your cancellation in writing to the tour operator or travel agent, specifying the travel contract number. Any travel documents that have already been provided must be returned. Instead, the organizer may demand reasonable compensation, taking into account the expenses that would normally have been saved and the income that could normally be earned by using the travel service for another purpose. Compensation will be calculated per person as follows, based on the date of receipt of the notice of cancellation (provided no replacement traveler is found):<\/p><p class=\"p1\">Bus Tours:<\/p><ul><li class=\"p1\">Up to the 31st day before the start of the trip: 20%<\/li><li class=\"p1\">50% starting 30 days before the trip begins<\/li><li class=\"p1\">75% starting 14 days before the trip begins<\/li><li class=\"p1\">Starting 7 days before the trip begins: 85%<\/li><li>From the 3rd day before the trip begins through the day of departure, or if the trip is not taken, 90%<\/li><\/ul><p class=\"p1\">Air Travel:<\/p><ul><li class=\"p1\">Up to the 31st day before the start of the trip: 25%<\/li><li class=\"p1\">55% starting 30 days before the trip begins<\/li><li class=\"p1\">80% starting 14 days before the trip begins<\/li><li class=\"p1\">Starting 7 days before the trip begins: 85%<\/li><li class=\"p1\">From the 3rd day before the trip begins through the day of departure, or if the trip is not taken, 90%<\/li><\/ul><p>Cruises:<\/p><ul><li class=\"p1\">Up to the 31st day before the start of the trip: 25%<\/li><li class=\"p1\">60% starting 30 days before the trip begins<\/li><li class=\"p1\">80% starting 14 days before the trip begins<\/li><li class=\"p1\">90% starting 7 days before the trip begins<\/li><li class=\"p1\">From the 3rd day before the trip begins through the day of departure, or if the trip is not taken, 95%<\/li><\/ul><p class=\"p1\">Travel on Your Own<\/p><ul><li class=\"p1\">Up to 31 days before departure: Amount of the deposit<\/li><li class=\"p1\">From the 30th day to the 22nd day before departure: 25% of the total price<\/li><li class=\"p1\">21st to 15th day before departure: 45% of the total price<\/li><li class=\"p1\">4 to 7 days before departure: 60% of the total price<\/li><li class=\"p1\">6 to 2 days before departure: 80% of the total price<\/li><li class=\"p1\">after that: 90% of the total price<\/li><\/ul><p class=\"p1\">Flight-only bookings:<\/p><ul><li class=\"p1\">Cancellation before the ticket is issued: 25\u20ac<\/li><li class=\"p1\">bei Stornierung nach Ausstellung des Tickets und vor Reiseantritt 100% Reisen mit dem Kauf von Eintrittskarten:<\/li><li class=\"p1\">For trips that involve the purchase of tickets (e.g., musicals) up to 22 days before departure: 30%; 21 days or fewer before departure: 80%.<\/li><\/ul><p class=\"p1\">9.2 The cancellation fees apply unless other terms have been agreed upon in individual solicitations or pre-contractual information. The traveler is free to prove that the tour operator incurred no damages at all or damages that were significantly lower than the lump-sum amount claimed by the tour operator.<\/p><p class=\"p1\">9.3 It is recommended that you purchase travel cancellation insurance. The insurer may cover the cancellation costs in accordance with its insurance policy terms and conditions for the insured risks.<\/p><h5>10. Cancellation by the traveler after the trip has begun<\/h5><p class=\"p1\">10.1 After the trip has begun, the traveler may withdraw from the travel contract; however, the traveler may not claim a refund for services already received and remains obligated to make the payments due.<\/p><p class=\"p1\">10.2 If the trip is canceled due to an accident or illness suffered by the traveler at the destination that prevents him or her from continuing the trip, the tour operator is obligated to provide the necessary assistance and, if applicable, to pay the difference between the services used and those not used, less any justified cancellation fees.<\/p><p class=\"p1\">10.3 In any case, all additional costs incurred as a result of the traveler\u2019s cancellation\u2014in particular, the cost of return transportation or transportation to the point of origin\u2014shall be borne by the traveler, unless otherwise specified in the General Terms and Conditions of Travel.<\/p><h5>11. Duty to Cooperate<\/h5><p class=\"p1\">11.1 The person who booked the trip or the traveler must notify the tour operator immediately if they have not received the necessary travel documents at least 7 days before the trip begins.<\/p><p class=\"p1\">11.2 If the trip is not provided free of defects, the traveler may demand that the defects be remedied. To the extent that the organizer was unable to remedy the situation due to a culpable failure to report the defect. The traveler is required to report any defects immediately to the tour operator&#8217;s local representative. If there is no such representative at the vacation destination\u2014or if the presence of such a representative is not contractually required\u2014any issues with the trip must be reported to the tour operator at its headquarters. Information regarding the availability of the contact persons will be provided in the service description, or at the latest with the travel confirmation. The traveler may also bring the notice of defects to the attention of the travel agent through whom he or she booked the package tour. Tour guides or other representatives of the tour operator at the vacation destination are not authorized to acknowledge claims. As soon as the tour operator receives the traveler&#8217;s notification, it must make every effort to find an appropriate solution.<\/p><p class=\"p1\">11.3 If the traveler fails to fulfill his or her obligation to promptly report travel deficiencies to the tour operator, the traveler shall be liable for all resulting disadvantages and damages arising from the failure to report such deficiencies.<\/p><p class=\"p1\">11.4 If the traveler wishes to terminate the travel contract due to a defect in the trip, the traveler must first give the tour operator a reasonable period of time to remedy the defect. This does not apply only if the organizer refuses to remedy the situation or if immediate remedial action is necessary.<\/p><p class=\"p1\">11.5 In the event of damage to, loss of, or delays in the delivery of luggage during air travel, the tour operator strongly recommends that you report the incident immediately on site by filing a Property Irregularity Report (P.I.R.) with the relevant airline. Airlines generally refuse to issue refunds if the claim form has not been filled out. Prevention of Return for Unavoidable and Extraordinary Reasons<\/h5><p class=\"p1\">12.1 In the event that the traveler\u2019s return as stipulated in the contract cannot be guaranteed due to unavoidable and extraordinary circumstances (including, among others, force majeure), the tour operator shall cover the costs of necessary accommodations\u2014if possible, in an equivalent category\u2014for a maximum period of 3 nights per traveler, unless the European regulations on passenger rights specify a different period.<\/p><p class=\"p1\">12.2 The cost limit specified in the previous section does not apply to people with disabilities or reduced mobility and their accompanying person, pregnant women, unaccompanied minors, or people requiring special medical care, provided that their special needs were communicated to the tour operator at least 48 hours before the start of the trip.<\/p><h5>13. Liability of the Tour Operator and the Traveler<\/h5><p class=\"p1\">13.1 The tour operator and, if applicable, the local agency are both jointly responsible to the traveler for the proper performance of the booked package tour in accordance with the contract.<\/p><p class=\"p1\">13.2 The tour operator and, if applicable, the local agency are liable to the traveler, regardless of whether they provide the services of the package tour themselves or have commissioned their agents or other service providers to carry out the tour.<\/p><p class=\"p1\">13.3 The tour operator is not responsible for the following circumstances: a) The travel-related issues in question are attributable to the traveler b) The travel deficiencies are attributable to a third party unrelated to the business, who has no connection to the provision of the services specified in the travel contract, and which are unforeseeable and insurmountable. c) The travel disruptions were caused by events of force majeure that were unforeseeable and extraordinary, and whose consequences could not have been avoided despite the exercise of due care.<\/p><h5>14. Liability<\/h5><p class=\"p1\">14.1 The organizer\u2019s contractual liability for damages that are not bodily injury and were not caused by negligence is limited to three times the price of the trip. Any claims that may go beyond this limitation of liability under the Montreal Convention or the Air Transport Act remain unaffected by this limitation of liability.<\/p><p class=\"p1\">14.2 The organizer\u2019s tort liability for damages that are not bodily injury or violations of sexual autonomy and that were not caused by negligence is limited to three times the price of the trip.<\/p><p class=\"p1\">14.3 The tour operator is not liable for disruptions in services, personal injury, or property damage in connection with services that are merely arranged as third-party services (e.g., excursions, sporting events, theater visits, exhibitions, transportation services to and from the advertised departure and destination locations), provided that such services are expressly identified as third-party services in the travel brochure and the booking confirmation\u2014with the name of the contracted third-party provider specified\u2014in a manner so clear that it is evident to the traveler that they are not part of the organizer\u2019s travel services and were selected separately. However, we are liable if and to the extent that your damages were caused by our breach of our duties to provide notice, information, or organizational support.<\/p><h5>15. Complaints<\/h5><p class=\"p1\">15.1 Subject to any legal action that may be taken, the traveler may file a claim regarding the tour operator\u2019s failure to perform or improper performance of the travel contract by sending it to the following mailing or email addresses: a) Mailing address: SR Travel International S.L., Calle Buenos Aires 8, Office 1B, 35002 Las Palmas de Gran Canaria b) Email address: info@srtinternational.es<\/p><p class=\"p1\">15.2 The tour operator shall provide the traveler with a written response to his or her complaint within the maximum time limits prescribed by law.<\/p><h5>16. Other Provisions<\/h5><p class=\"p1\">16.1 The data provided to the organizer will be processed, stored, and disclosed for the purposes specified in the contract, and will be used for promotional purposes to the extent permitted by law. The organizer\u2019s privacy policy is available at www.srt-international.Personal data is protected in accordance with the currently applicable data protection regulations and is retained for as long as a contractual or business relationship with the traveler exists or until the traveler exercises their right to erasure or restriction of data processing, unless there is a legal obligation to retain the data for a longer period. To exercise their rights regarding the storage and use of their data, travelers may contact SR Travel International S.L. at any time at SR Travel International S.L., Calle Buenos Aires 8, Office 1B, 35002 Las Palmas de Gran Canaria, email address: info@srt-international.es. In addition, travelers may file a complaint with Spain\u2019s national data protection authority, the \u201cAgencia Espa\u00f1ola de Protecci\u00f3n de Datos\u201d (or \u201cAEPD\u201d for short, https:\/\/www.aepd.es\/)<\/p><p class=\"p1\">16.2 Obvious printing and calculation errors entitle the organizer to rescind the travel contract.<\/p><p class=\"p1\">16.3 The traveler has the right to seek legal recourse. All legal claims arising from the travel contract are barred by the statute of limitations two years after the discrepancy becomes known.<\/p><p class=\"p1\">16.4 The invalidity of individual provisions shall not render the entire travel contract invalid. It is agreed that Spanish law shall apply. For customers\/travelers who are not nationals of a member state of the European Union or Swiss citizens, it is agreed that Spanish law shall exclusively govern the entire legal and contractual relationship between the customer\/traveler and the tour operator.
